67 In the case of CC licences, the offer to conclude the licence agreement always comes from the original Licensor. If the Licensee passes on content, for example by making a CC-licensed photo on a website (for the definition of sharing, see section 1.i margin note 67), the licensee thereby simultaneously transmits the licensor's offer to third parties, thus acting as a messenger. If another licensee (third party) uses the material and obtains it from the source of the first licensee, the third party accepts the offer of the original licensor and a contract is concluded solely between the original licensor and the third party. See VorCCPL margin note 5 for information on the conclusion of the licence agreement.
